-lawyer Nyoka seeks arrest of investigating officers

MASVINGO –The trial of Masvingo lesbo girls who smashed the internet last year after they shared a video on social media which went viral while leaking each other’s private parts has been set for 29January.
The two ladies, Nyasha Chabika and Flora Tofa are facing charges for violating the Censorship and Entertainment Control Act, specifically the prohibition of importing, producing, and disseminating undesirable publications, pictures, statues, and records.
They are on ZW$100,000 bail and are being represented by Tatenda Nyoka.
During their routine appearance before Magistrate Elizabeth Hanzie on Wednesday, their lawyer, Nyoka sought a warrant of arrest of police officers investigating the matter who are holding the two ladies’ mobile phones.
Nyoka claimed that the investigating officers are using the phones to share personal information of the two ladies to the public and soliciting for money from the accused’s friends.
Nyasha and Flora were ordered to leave their phones and passwords at the Police station for further investigations, as part of their bail conditions.
The court then ordered the police to surrender the phones to the Clerk of court.
“We are pleading with the courts to grant my clients full custody of their cell phones and a warrant of arrest must be issued since the police are not complying with what the courts ordered them to do last time we appeared in court.
“The police are violating the law of invasion of privacy”, said Nyoka.
However prosecutors said the cell phones were in Harare for further forensic investigations and were only sent early this week with the rest of the information that is going to be used as evidence during trial.
Magistrate Hanzie then adjourned the case to allow the state to put its house in order before the trial commences on January 29.
