Fraud accused prominent Masvingo businessman, Naison Madyambwa almost wept as Magistrate Elizabeth Hanzi threw away his application for discharge.
Madyambwa who runs Hiepeg tyre services in Masvingo is facing charges of defrauding an Australian based lover turned investor, Achidaishe Mudzingwa of US$60 000 in a mining claim deal.
Through his lawyer, Charles Ndlovu of Ndlovu and Hwacha legal practitioners, the businessman was seeking to be freed on all fraud charges at the close of the state case.
However, Magistrate Hanzi found favour in the state’s case and the trial resumes on Wednesday, which almost made the businessman break in tears after her ruling.
His wife who has been religiously attending court sessions in solidarity with her husband while immaculately dressed in designer clothes a sign of the flamboyant lifestyle could not also stomach the outcome and left the court room in a huff as the before the magistrate had finished her ruling.
