ZPCS bid to evict Muzana suffers setback

CHIVHU- Zimbabwe Prisons and Correctional Services case against prominent Chivhu business mogul Kestry Muzana failed to kick off after the presiding magistrate said the applicant’s papers were not in order.

 ZPCS was ordered to pay the businessman costs of lawsuit on a higher scale for failing to put their papers in order and in time by Chivhu Resident Magistrate Tatenda Makwanya on December 15, 2025.

The resident magistrate gave ZPCS five working days ultimatum to put their house in order if they need to proceed with the case.

ZPCS had reported Muzana to court for contravening Section 3 (4) of the Gazetted Land Act Chapter 20:28 of occupying land without authority.

The Midweek Watch is in possession of the offer letter which Muzana was offered by Chikomba Rural District Council Eng. S. Machinga.

According to court records, circumstances are that, in July 2023, Muzana pitched a cabin some meters away from Chivhu ZPCS where he was given land by Chikomba Rural District Council through his offer letter issued on July 14, 2014.

Chivhu Prisons felt provoked and laid criminal charges against Muzana leading to his arrest on July 27, 2023.

Muzana produced the offer letter to the courts and he said due to financial challenges, he couldn’t develop the land in time and he only managed to develop it after securing some finances.

Chivhu Prison failed to provide documents to prove their case.

In 2023, the then Chivhu Magistrate Sam Chitumwa dismissed the claim after prosecution at Chivhu Magistrates Court declined to hear the case.
