Muzana, Chivhu Prisons in land ownership wrangle

CHIKOMBA – Chivhu Prisons’ bid to evict Kestry Muzana from a five hectare piece of land which they claim is theirs was dealt a double blow after the prosecution at Chivhu Magistrates Court declined to hear the case.

Prisons had reported Muzana to the court for contravening section 3 (4) of the Gazetted Land Act Chapter 20:28 of occupying land without authority.

The Midweek Watch is in possession of the letter which declined Chivhu Prisons’ criminal charge against Muzana which also highlighted that the complainant has initiated a civil action against Muzana.

Circumstances are that sometime in July this year, Muzana pitched a cabin some meters away from Chivhu police Station claiming to have an offer letter to the land.

Chivhu Prisons felt provoked and laid criminal charges against Muzana leading to his arrest on the 27th of July this year.

Muzana claims to have been given an offer letter by Chikomba Rural District Council in July 2014 but due to financial challenges, he couldn’t develop the land.

Chivhu Prison failed to provide documents to prove their case.

The land in dispute is 4km from Chivhu CBD.
