Master clears executor Mugwazi over Huni Estate

MASVINGO -Simbarashe Huni Estate executor, Kumbirai Mugwazi has been cleared of any wrong doing by the Master of High Cort in Harare following allegations of siphoning money meant for beneficiaries.

According to a letter in our possession from the Master of High Court, the theft allegations could have emanated from miscalculations, misunderstandings of statutory obligations and liabilities that are ordinarily incurred during the estate administration process.

“Given the opportunity to scrutinize the revised documents and adjustments made and it is our observations that the complainant is making allegations but failing to clearly substantiate them therefore in our view the executor has given remedy which appears to be satisfactory”.

The letter went on to say that they have noted that there were administrative and human errors which have been rectified for example the 6.5% executor’s commission and USD$67 000 which appears to have been captured in error and if there have been overpayment of any expense the executor is bound to refund accordingly.

The matter was brought before the Master after complaints were raised against Mugwazi by Huni’s second wife, Edeline Mashiri in 2022 where she alleged that the executor failed to put the beneficiaries interest first, failed to account for some estate funds, paid for some activities that did not relate to the management of the estate, inflating of estate expenses and continuously receiving estate funds after winding up of the estate.

Huni who worked in the President’s Office died during the height of COVID-19 in 2021 and left behind vast tracts of land in the lowveld, mines, houses in Masvingo City and Chiredzi, several vehicles, two wives and one child.
