MBERENGWA- For stabbing his roommate who had asked for passage to the toilet at night, Elvis Ncube, 25, of B Mine compound, Mberengwa has been sentenced to an effective three months’ imprisonment.
Ncube, who pleaded guilty to stabbing James Moyo, 50, with an okapi knife once in the head following a misunderstanding over his refusal to make way for his roommate who wanted to use the toilet at night, was sentenced to six months in prison by Mberengwa Magistrate Mehluli Moyo. Three months of the sentence were however suspended on condition of good behaviour.
The court heard that at around 11pm on February 1, 2022, Ncube stabbed Moyo of Village 2 Jahana, Chief Insiza after the latter asked him to move from his sleeping space which was on the door way of the room they were sleeping in as he wanted to go to the toilet.
Prosecuting Ali Mutaruse said that Moyo woke up with the intention of going to the toilet and on reaching where Ncube was, whom he shared a room with several other colleagues, he was told to go back and sleep. Ncube, whose sleeping space was at the door of the room, claimed Moyo was disturbing him.
Angered by Moyo’s insistence that he makes way for him, Ncube withdrew the knife and stabbed his victim once in the head. Moyo sustained a deep cut on the head from the knife attack.
